Diritto della distribuzione<\/strong><\/span><\/p>\n

I produttori di software come Microsoft o Corel consentono ai partner commerciali certificati (rivenditori) di vendere i propri prodotti ai consumatori. Vengono concessi i cosiddetti \u00abdiritti di rivendita\u00bb. Solo i partner autorizzati sono autorizzati a vendere licenze software e devono necessariamente aderire al programma partner del produttore. Ai rivenditori viene concesso un diritto non esclusivo di commercializzare e distribuire attivamente il software concesso in licenza all\u2019interno dell\u2019UE\/EFTA. Tuttavia, i partner commerciali possono operare anche in altre regioni; ci\u00f2 richiede un accordo scritto.<\/p>\n

Il distributore \u00e8 tenuto a proporre i prodotti software con i nomi di prodotto dei rispettivi produttori. \u00c8 necessario rispettare i diritti di propriet\u00e0 e le relative note sul copyright. Tutti i marchi commerciali e i marchi registrati sono di propriet\u00e0 dei rispettivi produttori. Le informazioni tecniche devono sempre corrispondere a quelle fornite dal produttore. Immagini, icone e loghi vengono utilizzati per identificare gli articoli. La merce venduta rimane di propriet\u00e0 del rivenditore fino al completo pagamento.<\/p>\n

Diritto delle licenze<\/strong><\/span><\/p>\n

Secondo l'attuale giurisprudenza della Corte federale di giustizia (BGH, sentenza del 17 luglio 2013 \u2013 I ZR 129\/08), i rivenditori specializzati sono tenuti a documentare la legalit\u00e0 e la legittimit\u00e0 del software offerto. Le licenze software possono essere immesse in circolazione solo con il consenso del titolare dei diritti. La licenza viene concessa in cambio di un pagamento che consente di percepire un corrispettivo corrispondente al valore economico del software. Il titolare dei diritti obbliga il distributore a vendere il software in modo definitivo, senza limiti di tempo per il suo utilizzo. Il consumatore viene informato che il software \u00e8 soggetto alle condizioni di licenza e ai diritti di utilizzo del prodotto del produttore del software.<\/p>\n

L'acquirente ha un diritto di utilizzo del software semplice e illimitato. Non \u00e8 autorizzato a copiarlo n\u00e9 a consentirne l'utilizzo ad altri. I diritti di utilizzo multiplo richiedono un accordo separato.<\/p>\n
