1. Basic layout<\/strong><\/p>\n

1.1. All transactions carried out by Gamecardshop (hereinafter referred to as the \u201cSeller\u201d) are exclusively based on these Terms and Conditions (hereinafter referred to as the \u201cT&Cs\u201d). They therefore also apply to all future business relationships, even if they are not expressly agreed upon again. The Buyer's (hereinafter referred to as the \u201cCustomer\u201d) reference to its general terms and conditions is hereby contradicted.<\/p>\n

1.2. These GTC apply to both consumers (\u00a7 13 BGB) and businesses (\u00a7 14 BGB). If the following terms and conditions do not contain a separate note, all conditions apply equally to contracts concluded with businesses and consumers.<\/p>\n

1.3. Additions or amendments to the terms and conditions require written confirmation from the transport company. The original purchase order is decisive for the content of the contract.<\/p>\n

1.4. We may make changes to the design and shape of the goods, provided that such changes are not fundamental in nature and that the purpose of the contract is not materially restricted.<\/p>\n

1.5 By placing an order in accordance with point 2.2, the customer accepts these T&Cs.<\/p>\n

2. Conclusion of the contract<\/strong><\/p>\n

2.1. The subject of the contract is the sale of downloadable products (digital content not supplied on a physical data carrier, such as product keys, access codes or other information available in digital form), including the corresponding licences. By placing the relevant downloadable product on our website, we make a firm offer to the customer to conclude a contract on the terms specified in the item description.<\/p>\n

2.2. In the case of a contract for the supply of digital goods, in the case of a contract for the supply of software (hereinafter: \u201csoftware purchase\u201d), the seller must transfer the software specified in the licence certificate in object code permanently. The seller is obliged to indicate the possibility of downloading the software and to provide a printed or downloadable version of the associated user documentation. Before full payment of the purchase price in accordance with Section 8, the delivered user documentation is subject to the seller's retention of title. The description of the relevant product in the seller's online shop or marketplace is decisive for the nature of the software. The seller must also grant the rights referred to in Section 4.8.<\/p>\n

2.3. The contract is concluded via the online shopping basket system: the customer places the selected products in the virtual shopping basket and completes the electronic ordering process. By clicking the button to complete the ordering process, the customer concludes a legally binding contract offer concerning the products contained in the basket. The customer may also send the offer to the seller via email.<\/p>\n

2.4. The seller may accept the customer\u2019s offer within five days by requesting the customer to pay after placing their order. This also includes selecting a method of payment in the ordering process, by which payment is made before the ordered products are dispatched. The period for acceptance of the offer commences on the day after the customer\u2019s offer is sent and ends at the end of the fifth day after the offer is sent. If the seller does not accept the customer\u2019s offer within the aforementioned period, this shall be deemed a rejection of the offer, so that the customer shall no longer be bound by their declaration of intent.<\/p>\n

2.5. Order processing and the transmission of all information necessary for the conclusion of the contract will be carried out by email, as will the delivery of downloadable products. The customer must therefore ensure that the email address they have provided is correct and that anti-spam filters do not prevent receipt of emails.<\/p>\n

3. Right of withdrawal<\/strong><\/p>\n

3.1. Consumers generally have a right of withdrawal.<\/p>\n

3.2. You can find more information about the right to withdraw in the seller's cancellation policy.<\/p>\n

3.3. You have the right to revoke this lifelong contract from the date of conclusion of the contract without giving a reason.<\/p>\n

4. Guarantee<\/span><\/strong><\/p>\n

4.1. Statutory warranty rights apply.<\/p>\n

4.2. The customer is requested to check the integrity and any apparent defects of the item immediately after delivery and to report any claims to us as soon as possible. If the customer does not do so, this does not affect their statutory warranty rights.<\/p>\n

4.3. With regard to the quality of the item, only our own information and the manufacturer's product description are considered agreed upon, not any other advertising, public promotions or statements by the manufacturer.<\/p>\n

4.4 The warranty period is one year from the delivery of the goods. The reduced duration does not apply:<\/p>\n

  • \n

    to damages resulting from injury to life, physical integrity or health, caused intentionally or by gross negligence on our part; ;<\/p>\n<\/li>\n

  • \n

    insofar as we have fraudulently concealed the defect or have assumed a guarantee concerning the state of the product; ;<\/p>\n<\/li>\n

  • \n

    in the event of any legal recourse you may have against us in relation to warranty rights.<\/p>\n<\/li>\n<\/ul>\n

    4.5. If the customer refuses delivery from the seller for a reason other than a significant defect that severely limits or makes use impossible, even though the seller has declared readiness to perform, the customer is in default of acceptance. Acceptance cannot be refused for minor defects.<\/p>\n

    4.6. The warranty does not cover defects resulting from inappropriate use, modifications to system components contrary to the contractual basis, inadequate organisational measures, use in hardware or software environments that do not meet the requirements specified in the licence certificate, unusual operating conditions, or interventions in the system by the customer or third parties.
    If the goods are used with third-party devices, a warranty for faults in functioning and performance only exists if these faults also appear without this connection or if compatibility with these components is part of the contractually agreed qualities.<\/p>\n

    4.7. If a delivery is defective, the seller may, at their discretion, rectify the defect (repair) or deliver an item free of defects (replacement). In the latter case, the customer is obliged, at the seller's request and in accordance with legal provisions, to return the defective goods.
    If the customer is a consumer, the preceding sentence applies with the clarification that the uses shall neither be returned nor compensated for their value.
    The customer must grant the seller the necessary time and opportunity for supplementary performance, in particular for repair.<\/p>\n

    4.8. Granting of rights in software delivery agreements
    Upon full payment of the purchase price, the customer is granted a non-exclusive and perpetual right to use the software, to the extent provided for by the contract.
    The seller may, at its discretion, provisionally authorise the use of the software before receipt of full payment.
    The software may only be used simultaneously by a maximum number of natural persons corresponding to the number of licences purchased by the customer.
    Authorised use includes installing the software, loading it into main memory and using it for its intended purpose.
    In no event shall the Customer have the right to rent, sublicense, publicly reproduce, make available by wired or wireless means, or make the Software available to third parties, whether for a fee or free of charge. Clause 4.9(c) remains unchanged.<\/p>\n

    4.9. Other rights of use
    a) The customer is permitted to make a backup copy of the software if it is necessary to ensure its future use.
    b) The customer may permanently transfer the purchased copy of the software, including the corresponding documentation, to a third party. In this case, the customer must completely cease using the software, delete all installed copies from its systems, and delete or return to the seller any copies stored on other data carriers, unless their retention is legally required.
    c) The customer must ensure that the third party expressly agrees to comply with the scope of rights granted under this Section 4.9. The division of purchased licence lots is strictly prohibited.<\/p>\n

    5. Price and Payment Terms<\/strong><\/p>\n

    5.1. Unless otherwise stated in the seller's product description, the prices shown are total prices including statutory sales tax. Any additional delivery and shipping costs are shown separately in the respective product description.<\/p>\n

    5.2. For shipments to countries outside the European Union, additional charges may be incurred on a case-by-case basis, for which the seller is not responsible and which are borne by the customer. These include, for example, bank transaction fees (transfer fees, foreign exchange fees) or import duties or taxes (customs duties). These charges may also be related to the money transfer if delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.<\/p>\n

    5.3. The payment option(s) shall be communicated to the customer on the seller's online shop or on the relevant online marketplace.<\/p>\n

    5.4. If an advance payment by bank transfer has been agreed, the payment is due immediately after the conclusion of the contract, unless the parties have agreed on a later due date.<\/p>\n

    5.5. In the event of payment via a payment method offered by the payment service provider PayPal (Europe) S.\u00e0 rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: \u201cPayPal\u201d), payment will be processed via PayPal, subject to PayPal\u2019s terms of use, available at https:\/\/www.paypal.com\/de\/webapps\/mpp\/ua\/useragreement-full, or, if the customer does not have a PayPal account, the terms applicable to payments without a PayPal account, available at https:\/\/www.paypal.com\/de\/webapps\/mpp\/ua\/privacywax-full.<\/p>\n

    5.6. If the customer is in default of payment, we shall be entitled to charge interest at the rate applied by commercial banks for overdrafts, but at least 4 % above the Bundesbank discount rate, plus the applicable statutory value added tax. Interest is payable immediately.<\/p>\n

    6. Delivery and shipping conditions<\/strong><\/p>\n

    6.1. The digital content will be made available to the customer electronically via a download link. Product keys will be sent to the customer by e-mail.<\/p>\n

     <\/p>\n

    7. Retention of title<\/strong><\/p>\n

    7.1. We reserve ownership of the goods until full payment of all claims we are entitled to from our business relationship with the customer.<\/p>\n

    7.2. The assertion of retention of title shall not constitute a termination of the contract. However, we are authorised to make other arrangements for the goods for which retention of title has been claimed after a reasonable period and to deliver the same or equivalent goods to the customer after full payment of the purchase price.<\/p>\n

    8. Final provisions<\/strong><\/p>\n

    8.1. The contractual partner is only permitted to assign rights and claims arising from the contractual relationship to third parties with the prior written consent of the seller. Section 354a of the German Commercial Code (HGB) is not affected; Section 354a HGB does not apply to consumers.<\/p>\n

    8.2. At the beginning of the business relationship, the client's data, which may also be personal data, will be stored and, to the extent necessary for the fulfilment of the order, processed and transmitted.<\/p>\n

    8.3. The applicable law shall be exclusively German law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods and any provisions relating to international private or procedural law. For consumers, this choice of law shall only apply to the extent that mandatory provisions of the law of the country in which the consumer has his habitual residence offer wider protection.<\/p>\n

    8.4. The exclusive place of jurisdiction for all disputes arising from contracts to which these T&Cs apply shall be the registered office of the seller; however, the seller reserves the right to sue the customer in any legally permitted place of jurisdiction.
