Droit de la distribution<\/strong><\/span><\/p>\n

Les fabricants de logiciels comme Microsoft ou Corel autorisent les partenaires commerciaux certifi\u00e9s (revendeurs) \u00e0 vendre des produits aux consommateurs. Les droits dits de revendeur sont accord\u00e9s. Seuls les partenaires autoris\u00e9s sont habilit\u00e9s \u00e0 vendre des licences logicielles et sont membres obligatoires du programme partenaire du fabricant. Les revendeurs se voient accorder le droit non exclusif de commercialiser et de distribuer activement des logiciels sous licence au sein de l'UE\/AELE. Cependant, les partenaires commerciaux peuvent \u00e9galement \u00eatre actifs dans d'autres r\u00e9gions, cela n\u00e9cessite un accord \u00e9crit.<\/p>\n

Le distributeur est tenu de proposer les produits logiciels sous les noms de produits respectifs des fabricants. Les droits de propri\u00e9t\u00e9 et les mentions de droits d'auteur pertinents doivent \u00eatre respect\u00e9s ou suivis. Toutes les marques et marques d\u00e9pos\u00e9es sont la propri\u00e9t\u00e9 de leurs fabricants respectifs. Les informations techniques doivent toujours correspondre aux informations du fabricant. Les images, ic\u00f4nes et logos sont utilis\u00e9s pour identifier les articles. Les marchandises vendues restent la propri\u00e9t\u00e9 du d\u00e9taillant jusqu'\u00e0 paiement complet.<\/p>\n

Droit des licences<\/strong><\/span><\/p>\n

Selon la jurisprudence actuelle de la Cour f\u00e9d\u00e9rale de justice (BGH, arr\u00eat du 17 juillet 2013 \u2013 I ZR 129\/08), les revendeurs sp\u00e9cialis\u00e9s sont tenus de documenter la l\u00e9galit\u00e9 et la conformit\u00e9 du logiciel propos\u00e9. Les licences de logiciel ne peuvent \u00eatre mises en circulation qu'avec le consentement du titulaire des droits. La licence est accord\u00e9e en \u00e9change d'un paiement qui permet d'obtenir des redevances correspondant \u00e0 la valeur \u00e9conomique du logiciel. Le titulaire des droits oblige le distributeur \u00e0 vendre le logiciel de mani\u00e8re permanente, sans limitation de dur\u00e9e d'utilisation. Le consommateur est inform\u00e9 que le logiciel est soumis aux conditions de licence et aux droits d'utilisation du produit du fabricant du logiciel.<\/p>\n

L'acheteur dispose d'un droit d'utilisation simple et illimit\u00e9 du logiciel. Il n'est pas autoris\u00e9 \u00e0 le copier ou \u00e0 en autoriser l'utilisation par des tiers. Les droits d'utilisation multiples n\u00e9cessitent un accord distinct.<\/p>\n
